TERMS AND CONDITIONS

SPECIAL EVENTS / HOLIDAYS:

Weekly rates are adjusted by Adding $250 for Christmas, New Years and Sportsman Season (Mini Lobster).

For all other Holidays and lobster season add $150.

Important Information:

Once you have entered into a contract to rent a property, you are binding yourself to that rental unit. There should be no expectation of compensation or relocation because you don't like the unit or something in the property is not working to your satisfaction. Unlike a hotel, we cannot relocate you without specific authorization from the owner. We will make every effort to correct any malfunctions or problems encountered, but no refunds should be expected. The owner of Island Palms Realty, Inc. reserves the right to cancel a confirmed reservation (with good reason) at any time prior to taking occupancy of the property. In the event this should occur, agent will refund all monies on account.

Rates & status of units by owners are subject to change without notice. Island Palms Realty, Inc. cannot be held responsible for any misinterpretation of this offering, errors or omissions. Please call us for any further clarification. We will be happy to explain our descriptions and rates.

One boat trailer plus two cars is the maximum parking capacity at any unit.

Unless otherwise noted, all units have air conditioning, cable TV, kitchens equipped for vacation-type cooking, bed linens, bath towels (bring BEACH TOWELS), and Charge Telephones - Free Local and 800 Calls. Make toll calls collect or put on credit card.

Pets:

Absolutely NO PETS ALLOWED (Unless ok'd by our office)! Anyone found with a pet will be immediately removed from the unit and their deposit will be forfeited as damages.

Unauthorized persons:

When you make your reservation, you will be asked the number of persons in your party including children. Maximum occupancy load is 1 person, regardless of age, per 200 square feet gross floor area (excluding garages, carports, screen rooms & storage areas) or 10 persons, whichever is less. The fine for exceeding the allowable number of guests is $500.00. The Guest License Agreement you sign will indicate the number of persons you will have in your unit. Any unauthorized persons will mean the forfeiture of your deposit.

Disclosure:

Island Palms Realty, Inc. offers our rentals properties without respect to the race, color, religion, sex, national origin, handicap or familial status of any guest.

Reservations:

After making a reservation, (when your booking date is more than 30 days from your arrival date) the rental agreement must be signed and returned with the first payment which is one-half of the gross rental amount and the travel insurance premium (unless waived) within 10 days of making the reservation or the reservation will automatically be cancelled. The remaining balance, one-half of the gross rental amount plus sales tax (11.5%) and the departure cleaning fee must be paid on or before arrival. If the arrival date is within 30 days, deposits must be made within 5 days of making the reservation. We accept Visa/Mastercard, Travelers Cheques and personal check. Checks are made payable to ISLAND PALMS REALTY, INC.

Cancellation Policy:

Once your reservation is confirmed any cancellations, changes in date, or switching of rental unit will invoke the cancellation policy. The deposit in the amount of one-half of the gross rental amount is non-refundable except for the following two reasons:

The deposit will be refunded only if the unit you have reserved is rented for same dates and price as your reservation.

The deposit will be refunded only if your reservation is during a officially declared and named hurricane by the Monroe County Emergency Management requiring a mandatory evacuation of tourists in Monroe County.

Security Deposits:

With the exception of reasonable wear and tear, the unit should be in as good condition upon check-out as it was at time of check-in. We require a minimum refundable $600.00 security deposit for each reservation. The security deposit is due with your final payment. If there are no damages or violations of Island Palms Realty, Inc. policies & regulations associated with your stay, the security deposit will be refunded by the same form of which you paid it within 10 days after your departure.

In lieu of the minimum refundable $600.00 security deposit, Island Palms Realty, Inc. offers Accidental Damage Waiver coverage. For a non-refundable payment of $45.00 (cannot be purchased after arrival) the security deposit is waived. This covers the rental unit during your stay for up to $1500.00 in unintentional damage. The unintentional damage must be reported to Keys Island Realty, Inc. prior to departure to be covered.

The Accidental Damage Waiver does not cover: Acts of God, intentional acts of guests, gross negligence or willful conduct, any loss or damage if not reported to Keys Island Realty, Inc. prior to check-out, normal wear and tear, any damages caused by any animal brought into the unit (animals are strictly prohibited), only physical damages to the property, it does not cover loss of use, loss or damage to any property owned by or brought onto the premises by the renter or renter's guests.

Island Palms Realty, Inc. has the sole authority to determine the extent of repairs necessary.

Rolling Over Reservations:

As an occupant of a specific rental unit, you have first right of refusal for the following year. These priority reservations must be made by Wednesday of the first week you occupy the unit. Upon renewal, one-half of the gross rental amount deposit must be made within 90 days after your departure. Otherwise, properties are released for reservations on a first request basis.

Checking In and Out:

Check-in time is FIRMLY set from 3:00 PM - 5:00 PM. Many houses are ready earlier, but even houses ready by 5:00 PM are not considered to be late. Most of our larger houses are ready closer to 5:00 PM (due to the nature of vacation rentals, the cleaning services can require additional time). Please do not purchase groceries before check-in. We are unable to let you into a home that is not ready, nor can we provide refrigeration facilities. Check-out time is NO LATER than 11:00 AM.

Evacuations and Trip Cancellation Insurance:

If the appropriate Monroe County authorities order a mandatory evacuation, you will be required to comply. You will be notified of our evacuation procedures and must turn in your keys prior to leaving the island.

Island Palms Realty, Inc. offers Vacation Travel Insurance through Travel Guard International. Upon making your reservation, you will be quoted a premium of 7% of the total cost of the rental, plus tax and departure cleaning fee. Island Palms Realty, Inc. is not an insurance company. Accomodations and Amenities:

All furnishings and equipment in all properties are provided by the owner, to the owner's taste. All units are set up for normal housekeeping: kitchen equipment, linens, towels, pillows are provided.

All equipment in each property should be in working order. Please report any inoperative equipment to our office immediately. We will make every reasonable effort to have the problem corrected. Please respect that emergencies take precedence.

Pools and Hot Tubs:

Pools and hot tubs are cleaned and maintained by a professional company on a regular schedule. Please do not tamper with chemicals or controls. No refunds will be given for non-use of pools or hot tubs caused by weather and/or mechanical problems.
